13. RIGHT OF WITHDRAWAL (EU/NL CONSUMERS)
If you are a consumer in the EU, you generally have the right to withdraw from your purchase within 14 days of receipt (statutory cooling-off period), unless an exception applies. You will receive a refund in accordance with the law and our return policy.
14. LIABILITY
To the extent permitted by law, we are not liable for indirect damages (such as consequential loss, loss of profit, or data loss) arising from use of the site or Service.
Nothing in these Terms excludes consumer rights that cannot be excluded under mandatory law, including the statutory 2-year conformity guarantee for products under EU legislation.

You agree to indemnify us against third-party claims arising from your breach of these Terms or your unlawful use of the Service.
16. SEVERABILITY
If any provision is found to be invalid, the remaining provisions shall remain in full force and effect.

These Terms remain in effect until terminated by you or by us. We may terminate access in the event of a breach of these Terms, to the extent permitted by law.

These Terms and all associated policies constitute the entire agreement between you and us with respect to use of the Service.
19. GOVERNING LAW
These Terms are governed by Dutch law. Disputes shall, to the extent permitted by law, be submitted to the competent court in the Netherlands.
20. CHANGES TO THE TERMS
We may update these Terms. The most recent version is always available on this page. Continued use of the site following any changes constitutes acceptance of the updated version.
21. Additional terms for residents of the United States
This section applies to you if you are located in the United States and supplements the Terms of Service set out above. In the event of any conflict between this section and the rest of these Terms, this section takes precedence for US residents.
21a. Governing law and jurisdiction (US residents)
Notwithstanding Section 19, if you are a consumer resident in the United States, these Terms will be governed by the laws of the State of New York, without regard to its conflict of law provisions. Any dispute not subject to arbitration (see Section 21c) shall be resolved in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction in those courts.
Nothing in this section limits any rights you may have under the mandatory consumer protection laws of your state of residence.
21b. Disclaimer of warranties (US residents)
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
This disclaimer does not affect any statutory rights you may have as a consumer under the laws of your state.
21c. Limitation of liability (US residents)
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AMARI (ARRA BY ARSKO) AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR ANY PRODUCTS PURCHASED THROUGH IT.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).
Some states do not allow the exclusion or limitation of certain damages. If you reside in such a state, some of the above limitations may not apply to you.
21d. Dispute resolution and informal resolution
Before initiating any formal legal proceeding, you agree to contact us at support@amaribaby.com and give us 30 days to attempt to resolve the dispute informally. Most concerns can be resolved quickly this way.
21e. Binding arbitration (US residents)
If we are unable to resolve a dispute informally within 30 days, any claim arising out of or relating to these Terms or your use of the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.
- Arbitration will be conducted in English
- For claims under USD $10,000, arbitration may be conducted by documents only, without an in-person hearing, unless either party requests otherwise
- The arbitrator may award the same remedies as a court, including injunctive relief on an individual basis
Nothing in this section prevents either party from seeking emergency injunctive relief from a court to prevent irreparable harm pending arbitration. This arbitration agreement does not apply to disputes that, by law, may not be subject to binding arbitration.
21f. Returns and refunds (US residents)
US consumers do not have a statutory right of withdrawal equivalent to the EU 14-day cooling-off period. However, as a matter of company policy, we offer a 14-day return window from the date of delivery for unused products in their original condition and packaging. Please refer to our Return and Refund Policy for full details.
This policy does not affect any statutory rights you may have under the laws of your state, including rights relating to defective or misdescribed goods.
